Case bundle lost in court!

(Querist) 16 June 2010 This query is : Resolved
My case is going on in a district consumer court. On my last hearing I was told that the entire case bundle is missing! I was told it will be found but it is one week and they are still unable to trace it. What is the recourse I have?
Daksh (Expert) 16 June 2010
Dear Praveen Kumar,

It is the Registry of the Consumer Forum which is supposed to keep track of the judicial files of the Forum. If particular bundle is not available as a usual procedure next date will be given with a direction to the registry to get the files traced and place on record on the next date of hearing (for the same purpose)
Best Regards

dear praven kumar,
your case bundle was unfotunately misplaced by the form the only one thing you have to do is to re constuct the case bundle
with the direction of the forum the material papers available with you and the other side submit the papers to the form for constructing the record.
GENERALLY THE FORM WILL NOT MISS THE RECORD MAY BE DUR TO OVER SITE THEY PLACED THE RECORD IN WRONG DATE.
IF THEY MISSED THE RECORD IT SHOWS THE NEGLIGENCY ON THE PART OF THE FORM.
YOU CAN TAKE ACTION AGANIST THE STAFF OF THE FORM FOR NOT TAKING CARE OF THE RECORD
BEST REGARDS

YOU MAY KINDLY NOTE THAT IT MAY BE A GENUINE MISTAKE AND THE CASE PAPERS MIGHT HAVE BEEN KEPT WITH OTHER CASE PAPERS IN DIFFERENT DATE.
YOU MAY FILE AN APPLICATION FOR CERTIFIED COPIES OF DOCUMENTS.
THE CONCERNED STAFF OF THE COURT WILL SERCH THEIR RECORDS AND PLACE THE FILE ON PROPER COURT RECORDS.PLEASE NOTE.
THANKS.
