Dear experts,

In a judgement, the court had held that the father cannot be joined as a party to a suit u/s. 138 in which he had issued a cheque on behalf of his son for the son's debt. I am unable to recollect the Judgement name and the court which had passed it. If any one has knowledge of the said judgement kindly post it here.

the latest one I am having is from the P&H high court

titled as:

Tarun Aggarwal v/s Vivek Singhal 2009(2) Recent Criminal Reports 741.

in this judgment the referrence has been given to

S.M.S Pharmaceuticals Ltd. V/s Neeta Bhalla, 2005 (4) RCR (criminal) 141; 2005 (3) Apex Criminal 229 (SC)

if possible make a search under head VICARIOUS LIABILITY.
