This query is : Resolved
IN A PRIVATE FIRM THE EMPLOYEE WAS TERMINATED WITHOUT ANY NOTICE AND ALSO DID NOT PAY HIM. THE EMPLOYEE FILED CASE IN CIVIL COURT FOR RECOVERY OF HIS DUES. IN THE MEANTIME THE EMPLOYER FILED MULTIPLE FALSE COMPLAINTS WITH POLICE SO THAT EMPLOYEE COULD NOT PROCEED HIS LEGAL RIGHTS AND JUST TO PUT PRESSURE SO THAT EMPLOYEE MAY WITHDRAW THE CIVIL CASE. AFTER SEEING THAT EMPLOYER MAY LOOSE HIS CASE UNDER UNDER THE GRAB USING HIS MONEY AND POWER SETTLED THE MATTER AND PAID TO EMPLOYEE SOMEWHAT AS EMPLOYEE HAD NO ALTERNATIVE AFRAID THAT POLICE MIGHT REGISTER FALSE FIR. MY QUERY IS CAN EMPLOYEE FILE CASE OF DEFAMATION AGAINST THE EMPLOYER AS THE EMPLOYEE HAD SUFFERED ALOT DUE TO FALSE COMPLAINTS. IN CASE EMPLOYEE FILES CASE OF DEFAMATION CAN EMPLOYER CAN FILE FALSE COMPLAINTS. PL ADVICE.

There is no ingredients found in your query to file a defamation case, hence better not to pursue any legal proceedings out of frustrations.

Due to the circumstances, the employee withdrew the case and took the amount so he cannot file the case of defamation.

The facts so far discussed by you do not show any direct cause fo action for defamation.

Dear Experts I understand the concerns but under immense pressure by the employer and police I had to accept the meagre amount besides no job afforded. The query is that employer filed false complaints of theft and data cyber and now settled and paid the amount whatsoever which strongly proves that employer was at fault else why he would pay the amount to employee. Any remedy since civil court case still pending.

Since you accepted the amount settled by the employer and subsequently the case filed by him was withdrawn, all these things happened with your knowledge and consent, if at all you were really aggrieved, you would have refused the settlement and would have challenged the false complaint and then sued the employer for defamation if you have got the case dismissed after full trial.
Whereas now your intention to wreak vengeance agaisnt the employer is clear which is an afterthought, hence no case is maintainable.
Don't venture into any legal action because it is not ternable neither your case will be entertained.

If you are keen on defamation (bailalable) case then you can find the source in the police complaints against you which you say are false.
You need to meet a laweyr with all the papers.
