Case transfer from one court to another.

(Querist) 24 June 2016 This query is : Resolved 
A person who has been accused of criminal activities is under trial for criminal proceedings under First Class Judicial Magistrate of a court and has been granted bail for non bailable offence but the person wishes to get the charge sheet filed in another court but under jurisdiction of same High Court as the lawyer of the accused person had a sort of cold war with the First Class Judicial Magistrate few years back and so he is not in a position to represent the case of the accused and the judge while granting the bail delayed the procedure of bail which led to spending of 1 week in prison. Is it possible to file a charge-sheet in another court?

No, only the investigating team will submit charge sheet unless the IO is changed by the order of the court.

He can change his lawyer if he is afraid that court may be biased with the present lawyer.
