Cast verification

(Querist) 26 August 2017 This query is : Resolved
Sir
Kindly clarify me according to special marriage act 1954 what should be the cast of a woman considered if she belongs to general family by birth but married with SC Hindu man in 2003. According to the law of that time what should be the cast of that woman.
Sudhir Kumar, Advocate (Expert) 27 August 2017
Marriage does not change the cast status.

she retains the same cast status as was prior to marriage.

Thanks sir,but is there any notification about the cast verification of women before the judgement of high court came in 2010?
Rajendra K Goyal (Expert) 27 August 2017
Special marriage act is for marriage between different religion.

Caste would be as per birth.

Please give gist / citation of the judgement referred by you.
Dr J C Vashista (Expert) 27 August 2017
Caste and religion are two different connotations which should not be mixed. General caste and SC caste are part and parcel of Hindu religion.

Both (the boy and girl) are Hindu irrespective of their caste, the marriage shall be solemnised and performed as per Hindu rites and customs, as could be found from given facts.

Provisions of Special Marriage Act apply where there is different religion.
