Certificates not returned

hi sir...
I'm Dr.M.Mallikeswaraja , currently employed under tamil nadu health department. They demanded for my original certificates on the day of admission following which i had to do so. Now I'm in need of my certificates for applying for higher education exams. When i approached them they simply rejected stating that i'm under a bond to serve them for three years. What should i do. pls help. eagerly awaiting your repl

Tamil Nadu Government does not retain the originals of the employees.

Even if there is bond, even if they have retained the originals, they have to return that. Send a request letter to return the originals.

The original certificates are your property and employer has no lien on it.

There are judgments by courts of law deciding that employer can not retain the original educational certificates.


Transact in writing under proper acknowledgment.

thank you so much sirs for your valuable reply... can you please tell me in detail about how i should preceed further. last time when I submitted the requisition they just cancelled it and i ve not got any reason for it till now. do i ve to send the letter through an advocate or through police???

Send a legal notice to return your original certificate, failing which you can lodge a diary to the police and file a criminal case against the authority.

First of all create evidence by first sending a letter requesting to return your original documents/certificates under a registered post, if you dont get a reply within the stipulated time, you may resort to legal action by starting with the legal notice.
