(Querist) 14 November 2011 This query is : Resolved 
Asansol Civil Court does not have a proper Xerox Machine and is always running short of xerox papers. As a result of which Certified copies of cases and judgemnts are not available even on special request petitions for months together.

Due to this, citizens ,both plaintiffs and defendents are unable to appeal in higher forum and the high court.

The Law Minister Of West Bengal, who is also an MLA from Asansol itself has also failed to resolve the issue.

The lawyers used to "MANAGE" some copies at exhorbitant fees, but there was some tiff amongst the lawyers and this has also stopped.

Lawyers explian the the court has ordered only 40 sheets per day to be xeroxed and the turn may come after years.

As a ordinary citizen, I fail to undestand who should be approacehed to resolve the problem.

Even the bar association is silent and docile about the matter.

It is also a known fact that lower courts are very conservative on Judgements and even simple injunctions are rejected on filmsy ground.

As things stand, Only Persons interested in geeting matters lingered go to the court.

What is the meaning of Justice delayed is justice denied?

Please help.

The citizens Forum is even willing to sponsor a new Xerox Machine.

send a complaint to registrar of high court and the district judge. Then file a writ PIL . you will get relief.

It is not Asansol itself even some other remote cities of WB suffer from this problem, Apart for lodging complaints you can try for typed CC.

I DO NOT SEE ANY APPROACH IS THE SOLUTION.
THEN AS SUGGESTED PIL IS THE ONLY REMEDY. THAT TOO WITH RISK OF MAXIM 'Justice delayed is justice denied'
MANY A TIME I CONFRONT SUCH PROBLEMS LIKE ONE OF YOURS THAT I FEEL ONLY SORRY FOR BEING A LAWYER.

BECAUSE A LAWYER WHO CAN NOT PROVIDE A REMEDY TO A GENUINE CAUSE THEN HE IS NOT A LAWYER.I FEEL SO.HOW OTHERS VIEW IS UNKNOWN TO ME.

As regards to fact that injunctions are being rejected on filmsy ground.It is going on a policy of maintenance of justice every where that suit of injunctions where interim injunction is sought be construed strictly on norms.Since their files in which they grant interim injunctions are administratively scrutinized,they feel rejection a security .

Any way till a PIL advised does get filed,it would be better to APPROACH the District judge with the offer the citizen forum has to sponsor a new Xerox Machine.

You being a representative of citizen forum should immediately meet District Judge of Asansol and should donate the machine as mentioned and should request to run it at their own cost. PIL shall take a long time to decide.

This new State Govt. is more hopeless than previous one. Previously the bribery amount was minimal demanded.

Before launching a PIL, you may have to use several other methods to expose the lawlessness in home of law to move the official machinery.

1) Try through RTI to get maximum information about No. of Xerox machines, No. of court cases decided with No. of pages of jugments, No. of certified copies with total No. of pages provided on month to month basis, No. of cases with period for which judgments not provided, reason for delay or non-delivery of judgments to the parties, etc

2) Approach Paper and Electronic media to extract maximum information from the courts and publish as news items on day to day basis.

3) Take the help of NGOs.

4) Report matter to the Law Minister of India with copy to various MPs of opposition, etc.

Thanks to all the experts for thier more or less unanimous suggestion. Notice has been served to Distrct Judge. The matter has been reported in the media with comments from several local Advocates in our favour. The law minister has assured the media that arrangements have been made and new xerox machine is being installed soon. Thanking all the experts once again
