Challenging the Lower Court Order?

Querist : Anonymous (Querist) 04 August 2010 This query is : Resolved
Que.1.Since ours is a Federal form of Government in this regard I would like to know if the Lower Court Order of one State can be challenged in the HC of Other state by Citing the case of that particular HC Previous Order?

Some of you(Experts) might say why not challenge in the same State HC with the same citation of other HC, but that would not answer my question with regards to India`s Federalism?

The notion of Federalism has got nothing to do with your query. In Federal state the Central govt dicentralise certain powers to the state where the issues relating to national importance still remains with it. There are more other issues also.
If the proposal made by you is implemented then there will be nothing but mis administration in every aspect. Then why no the chief minister of one state would rule the other state or police of one state would not control the law and order in the other state.

barman is absolutely right.

the order of one court can be challenged by way of appeal or revision before the Superior authority of that Court and not any other Court
