This query is : Resolved
My wife filled 498a, 323, 504, 506 & 313 on me and my family members i.e brother, mother, sister-in-law (Criminal Law). Marriage constituted on 29.11.15 and she left law's home in April 2016 and made fabricated charge against my family.
1. She had not submitted any medicals document regarding abortion. On the other hand we have provided many medical documents to IO in our support on 15.10.2016.
2. One brother is in Indian Air Force (in Assam) and he is not getting leave due to ‘Tension grows between India and Pakistan’ and IO and SHO are insisting to call my brother immediately to Police Station otherwise they will send arrest warrant to him in Assam. He occasionally visited his parental home.
3. My sister-in-law is living 4 KM is separated house and from March 2016 to till date she has suffered from brain clotting (Medical Records are shown to SHO and IO) but IO is not ready to her take my brother and sister-in-law out from FIR.
4. IO told that due to IPC 313 you will not get any bail from session court.
5. No FIR copy supplied to me.
6. We have not taken any dowry as her father is a meson in village and mediator is wife's uncle. Mediator may give statement in our favor but at this stage, I came to know that my wife is preparing dowry items list through her lawyer.
It is requested, how to fight against the points mentioned above.

Immediately Consult A Local Good Senior Advocate and Obtain Anticipatory Bail for all of you Stating All the Facts Including your brother's detail and Let your Advocate Plead to Exempt/Exclude him from the case.Better Act Fast.Honorable High Court Would Certainly Consider your Brother's Plead. If any Document to be Signed by your Brother Let him use Jet Cargo and the Documents would be delivered on same day Including Sunday depending on Jet Flights Or Speed Post would be the Next Option.Act Fast.Even regarding your Sister in law's situation the Plead for Exemption to be made

You can't defend such a case without the help of a lawyer. So, must not delay. Hire services of some expert lawyer without any delay.

It appears the IO is overreaching. Anyhow, you require the professional services of a good lawyer.

FIR has already registered. Whether anticipatory bail is required for family members if found innocent in Deputy Superintendent's (Police) investigation.
