Dear Sir, After roving enquiry police file chargesheet for false complaint. (IPC 294(B),341,506(1)). FIR consists six IPC viz. 264(b),341,419,468,471,506(1). Initially, we filed petition Judicial Magistrate (private complaint) after FIR registered at local police station case transfered to District Crime Branch. DCB filed chargesheet only three section IPC 294(b), 341, 506(1) no evidence submitted by us. but we submitted evidence for 419,468, 471. CC number also provided by court. What we can do for to add another three section. And remove false section 294(b),341, 506 Becasue of, my advocate got signature from my father for the false section and got order to register FIR. What we can do now to add three section viz. 419,468,471 and chargesheeted three section 294(b), 341, 506(1). My father ready to tell magistrate I signed the paper without reading for section 294(b),341, 506(1), how can possible IO file chargesheet for 294(b),341, 506(1), without any eye witness. May I ask magistrate to take criminal action against IO or? what remedy to correct chargesheet only for 419,468,471. Advise please.

You can ask for reinvestigation.
You can ask for addition or deletion of particular Charge.
But you can not ask for punishment of IO.

Move an application under section 173 (8) of Criminal Procedure Code seeking re-investigation of the enquiry from a senior impartial IO.
