Cheated by the lawyer

Dear Sir,

I had a stay order in the property of my organization and we hired a Lawyer to take up the case. The lawyer asked a fee of Rs. 10,000 with a condition of complete advance payment and he assured to revoke the stay order within a month. Now it has been more than a year and he is lingering the case and at times not even picking the phone.

What are the legal avenues to tackle this particular situation.

Note. There is no written agreement with the lawyer.
The fee paid to him was vide cheque.

As per of practicle of act, any one could not revoke the stay within certain limit, if you hired any lawyer not possible, in which you could not take action against the advocate, same time its not in easy to revoke the stay, so you pls understand our professional risk.

no lawyer can guarantee the results of litigaton . if the lawyer has appeared and fought on your behalf but no stay is granted then you cannot seek to recover the fes paid to him . the lawyer has not addressed any letter wherein he guaranteed the results .

Agreement you entered into with lawyer is void and not enforceable at law by you.

Lawyer shall say he charged fees for his work and not for result.

If you are not satisfied with the work of the lawyer, you can change the lawyer. You cannot recover the fees even if stay is not granted.

Settle the issue with your lawyer qua the misunderstanding otherwise if he is defending the case properly then go on.
