cheating by company

I hv booked flat and company issued allotkent letter. I have made 3 instalment. No demand letter thereacter. No written agrement. On earlier occasioncl they isssued demand letter and i paid amount. Till date construction was not completed.payment was made and companyvis having office at vikroli mumbai and site is at thane. All payment is made by cheque. Now the company is saying since i hav not made timely payment and therfore same is cancelled. Can i file cheating case against the director?please advice me.

contact a local lawyer with the case papers . you can move consumer forum against the builder to direct him to handover possession on payment of installments agreed upon .

First of all file a consumer complaint and seek cancellation of the allotment and then only file FIR as desired.
