Cheating in chitfund...

(Querist) 22 November 2012 This query is : Resolved
One of our collegues started a chitfund and operated for some time. Due to unforeseen reasons, he could not continue it any more and stopped operations 6 years ago without any notice to the members. He owes to the extent of tens of lakhs(chits & deposits) to chit members and is refusing to pay back inspite of so many reminders. He has house properties and is not willing to dispose them off to pay back debts as he is not there directly in the business since he is a full time govt employee.
When pressed, he always cites the reason of issue being subjudice and is trying to get the properties attached of those who owe him. He expects us to wait till all those collections are made.
what is the quickest way of legal remedy to get back our money since we have already waited enough.

Raj Kumar Makkad (Expert) 24 November 2012
Make police complaint of forgery against him with copies to his department and see the result.
Sudhir Kumar, Advocate (Expert) 30 June 2013
Agreed with experts above.

I will add.

Full time Govt employee is not allowed to conduct any business in any other persons name also.

Further he is under obligation to maintain absolute integrity even in private life. He is liable for disciplinary action.

no add needed after add of Mr. Sudhir Kumar
