Check bounce case

Respected sir,

for CHEQUE BOUNCE case, which is more effective way of handling from 1) money recovery point of view ,2) from punishment to the defaulter .

1) filing 138 case
2) filing case in consumer court

for consumer cour is it necessary to file the case within 30 days from cheque bounce.

for consumer court same amount of stamp duty is required as that of 138 case ( in Maharashtra State 2% of cheque amount)

Unless the defaulter is service provider no consumer case lies only because the cheque gets dishonoured.

No consumer case lies against service which depends on stock market.
