Cheque bounce

(Querist) 12 September 2015 This query is : Resolved
I received a cheque which got bounced and I did not send a legal notice to the issuer. Its been two months now. What action can I take. Please advise.

If you know what for the cheque was issued to you by the other party, and if you have documents to back your claim (apart from the cheque), then you can file a summary suit (Order 37 CPC) for recovery of money. It is a quick process.

Case under NIACT is a gone conclusion,as the requisite time has elapsed.Hence only a civil suit is possible if U have some other documents.
malipeddi jaggarao (Expert) 12 September 2015
Agreed with experts. You do not loose your claim, but you cannot invoke action under Sec.138 of NI Act.
Rajendra K Goyal (Expert) 12 September 2015
If the cheque is within the validity limit, present again and send notice on bouncing.

You can file civil suit for your claim.

Can file criminal complaint for fraud and cheating.

Consult local lawyer.

Anonymous author with academic query.
However, as advised by the experts (I agree), proceed with the professional service of a local lawyer.

Well advised by most of the experts, the author to look for further course of legal action if at all he has any claim.
