Cheque Bounce

(Querist) 04 September 2018 This query is : Resolved 
I had issued a cheque as commission for a work which was not initiatef by Agent and Smartly he has bounced the cheque and sent a notice for which I am not liable. There is no document signed between us. What can be done in this situation. Please advice

Simply keep silent for the time being. Notice is not a problem, but the petition under sec. 138 can be. Wait for the agent to file a petition. Your defense strategy depends upon the contents of the petition, not on notice. Give him chance to prove, if commission became due.

Visibly similarly, as smartly he has tried to seek answer to an academic query by presenting the event as his personal problem. Obviously, no businessman gives cheque for undue commission in advance without seeing output of the agent.
