Hello- my father is a proprietor of a trading unit for last 15 years, and he is received a summons of cheque bouncing case in sep 2013- but due to his medical problems he is not able to attend any court proceedings,. and now honourable judge issued some arrest warrant against him. i just want to know how these warrants can cancelled and should i attend the same case of behalf of my father.plz help me out in this regard.

your father may file petition to dispense the personal appearance u/s 205 of cr.p.c. for his inability and further to recall the warrant issue by court, your father may file a petition u/s 70(2) of Cr.p.c. before court

Apply u/s 205, and with Medical certificate for cancellation of Warrant.
If amount is small, Pay & settle.

Thank you sir, but i am in delhi and the criminal case is in mumbai. could you plz suggest me the lawyer who help me out in this regard. cheque- amount is 30 lacs and we made an payment of 10 lacs in it.now we have rejected material lying with us and company refuse to take that material. and also company wants that we should pay them rest 20 lacs. we have to take some schemes from the company too which they refuse to give us. kindlly suggest.

Your father has to appear at least for one time for obtaining bail, which will be granted to him. On that day he can apply for permanent exemption u's 205 Cr.P.C, which may be allowed by court and then he can be easily defended by his lawyer in court.

thanks sir, but my father is handicaped and dont walk or stand for too long, his medical position is very poor. he is medically 50% handicaped. kindlly suggest what to do. i am ready to go there in mumbai on behalf of my father.should i sumitt thing or do something on his behalf. waiting....
