(2 of 1974), S.164 - Criminal Procedure - Section 164 (1) - Statement under - If a witness can approach magistrate to record his statement - Plea of disinclination of investigating agency to record statement - If sufficient to approach the magistrate directly. Held that the provision cannot be interpreted as empowering the magistrate to record the statement of a person unsponsored by investigating agency.
