Civil case under o.s

Sir this is niranjan who is residing in tumkur Karnataka.I am running a partition suit on behalf my wife in tumkur.
Case details:
My wife is a major and her father died in 2008 when she was minor.my wife father Owens 6 acres of land which are undivided joint family property and land records stands still it's in the name of her father. My wife having another yelder sister and she is also married to an another person and they are living with my wife mother in my father home and enjoying the property and it's finandian means which are good yielding plantation situated in 6acres of said property.now my wife elder sister husband is looking over the property and he is refusing and the driving force on behalf of my elder sister not to make an partition of the said
Property now he is saying that he is married under manvalthana basis and protesting not to give property to my wife at the end I want to know is that my wife will have any legitimate share over her fathers ancestral property and can she get means profit until the declaration if case pls assist me to know the actual facts please do in need full

Definitely your wife will get share in the suit properties. She is also one of the legal heirs of her deceased father.

She has share in the property of her father expired intestate. Follow up the case in the court.

The property is self acquired/HUF/ancestral?


What was the personal faith of deceased e.g; Hindu?

4 acres is ancestral property and 2 acres is obtained by selling 3 acres of ancestral property and we are Hindu undivided family and this is agricultural land and having good yeald of arcanut and coconut plantation
