Civil misc application - no date mentioned in service of notice:

(Querist) 27 January 2014 This query is : Resolved 
Can Experts provide Inputs if opposite party Does Not Mention the Date of Listing - in Notice of Service for Urgent Filing at Delhi High Court,and

then quite shrewedly gets the matter listed almost after a gap of 10days from the Date of Service . Also in the Memo of Parties deliberately and Intentionally Incorrect Address of the Petition Filing the Appeal is mentioned.

and also deliberately and intentionally certain order sheets have also been withheld.


Will at the Outset the above grounds will be reasons enough for the Ld. High Court to dismiss the petition as the petitioner has approached the court with unclean hands.

INSPECT UR CASE FILE OF DHC TO KNOW THE REAL FACTS AND THEN FILE UR REPLY/APPLICATION STATING ALL ABOUT SUCH CHEATING TACTICS OF PETITIONER.
MOREOVER, DHC WILL DECIDE PETITION/APPEAL ON MERITS OF CASE/APPEAL.

Thanks Sh.Nanda. There are citations from SC that if a litigant has approached the court with unclean hands. he/she cannot claim relief and such litigants needs to be shown the door of the court. My query is that Since the petitioner in this query as stated have sent me notice for service without mentioning the date of listing proposed, and also in the Memo of Parties petitioner has given false address of the petitioner; the aforesaid 2 points if raised by me should be sufficient to Recall the Order and pass strictures against the petitioner. There should not be the need to decide the case on merits as the petitioner in this case has approached with unclean hands. Kindly clarify. Equally disappointing is that DHC disposed off the case in first hearing without even giving me an opportunity of being heard at all.Pls clarify....Thanks...
