Querist : Anonymous (Querist) 23 June 2011 This query is : Resolved 
a decree passed by lok adalat is not challenged by appeallet court, only remedy is writ jurisdiction for set aside the decree passed by lok adalat.
my problem- can i file misscellaneous case before lok adalat for set aside the decree on the basis of fraud.please give me suggestion regarding this problem so i can file misscellaneous case.

You can file a fresh civil suit for cancellation of decree on the on the ground of fraud.

Lok Adalat orders are not appeable as it is usually passed by consent of the parties. However, it has to go to the court from where the matter was sent for passing a valid decree. U may plead fraud over there or U may on your own make an application to the court.
