Claiming 5 months increase in rent as arrears

I am staying in Kodambakkam for 1.7 yrs. We had signed an agreement for 11 months from 1 sep to 31 july 2010 deposit amt- Rs.80,000, Rent Rs.8,000 per month for single bhk. We have not renewed the agreement bcz of good faith but now the landlord is demanding for 10% in the rent and informed in the month of dec 2010 and we agreed to pay the rent of Rs 8,800 from the month of jan 2011. but he is demanding for the arrears amt of Rs.4000 for the past 5 months. I dont think so it is not fair to demand arrears without our consideration.

We are not agree for the arrear concept and he said he will deduct from the advance amt and ask us to vacate the house. Since he have 2 months notice period we have looking for a good house. I really get depressed due to bad behaviour of the landlord.

How can i manage the situation. Money doesn't mater for us but we should not cheated by any one.

Kindly guide us....

It is your responsibility to renew the agreement. If their is a recital in your earlier agreement to enhance the rent amount after the completion of 11 months you will bind on that. He can not vecate you without due process of law.
