Clarification on electricity billing for an advocate office.

Dear All professional collegues i am an advocate and running an office in my residential apartment flat. one day electrical department person visted office and noted all systems switches and plugs and issued a demand notice for unauthorised usage. I heared that supreme court judgement is there for the same. guide me pls.

Pl. see M.P.Electricity Board vs. Shiv Narayan (2005) 7 SCC 283. In this case the SC came to the conclusion that the lawyer's office is not a commercial establishment. However, in view of the decision in NDMC vs. Sohan Lal Sachdev (2000) 2 SCC 494 which held otherwise (and which decision the Bench doubted), the matter was referred to the Chief Justice of India for referring the matter to larger bench.

However, no further details are available - as to whether the LB was constituted and if so the outcome thereof.

It is quite easy to say that entire procedure (I am not sure what procedure that you are talking about here) is illegal.

Please support your view with any decision of the Court. Without that, what you say does not carry any weight at all.

While agreeing with comments advanced by Mr.Anirudh,the querist has said" noted all systems switches and plugs and issued a demand notice for unauthorised usage."

SO IT MIGHT BE A CASE OF USING LOAD MORE THAN IN THE AGREEMENT AND THEN THERE IS NO WRONG ON ED part.
