Clerical Mistake in bail order

(Querist) 21 October 2009 This query is : Resolved
Sir,
Whether magistrate can correct the clerical mistake in his bail order? If yes under what Sections of Cr.P.C.?
If He does so after the copy of such order has been issued, is it an irregularity?
Raj Kumar Makkad (Expert) 21 October 2009
clerical error can be corrected at any moment without even having any specific provision because rule of law shall prevail only if such power is vested in the magistrate issuing the orders. This is not an irregularity.
PALNITKAR V.V. (Expert) 22 October 2009
The sections governing Judgment in CrPC make it clear that clerical mistakes can be corrected.
