Query No.1 Given below is two situations. Under which situation a Co-op. Housing Society can be said to be formed : 1)On the date on which a Co-op. Housing Society gets registered with Co-op. Housing Society Registrar. -OR- 2)On the date on which the Promoter (Builder/Developer) hands over the said Housing Society to the members.
Query No.2 On the date of Co-op. Housing Society Handover - to whom (from amongst the below mentioned two options) should Promoter hand over tha Co-op. Housing Society : 1)Flat owners who have signed the Registration Form and become members (shareholders) automatically on its registration by The Co-op. Housing Society Registrar. -OR- 2)Those who have not signed the Registration Form but had purchased flat in the said Society.

Registration is an official approval for the formation of the society, while formation is given effect on the date of election of the members of the managing committee, may that be on interim basis till due formal elections are conducted by the majority vote of the members of the society, or the date of registration, whichever is later. .

The date of registration and issue of the registration certificate by the Registrar of Co-Op Housing Societies is the date when a Society is called a registered CHS. You should understand that the application has to be submitted by a specified number of members who are termed as promoter members.

The society comes into its existence on the date of registration with RCS. The builder/promoter is liable to handover possession to flat to individual member of Society and allottee, on the basis of an authority given by the Society.
