This query is : Resolved
Being a member of the co-operative Hsg. Society I have requested to Secretary of the Society a copy of the as build drawing of the Society. In-spite of reminders I have not yet received the copy so far. Can I issue legal notice to the Society on the alleged deficiency of services under the Consumer Protection Act. Thanks in advance for your valuable views.

you mean to say building plans sanctioned ?does society have same on record? mostly builder dont give copy of plans sanctioned by BMC . make RTI application with BMC for copy of plans

Even if builder has not given, which i believe he is duty bound to give. Can we not ask this from Society. Let society obtain it from BMC or any other regulatory authority. I am more on status of member of the Society as a consumer in terms of the Consumer Protection Act.

Yes RTI is more effective than CP Act.
You can lodge complaint with Registrar as well.

CP Act does not at all apply to cooperative society.
you can exercise RTI to get the copy of map from municipality.
Society will never (never) give you.

Agree with the expert Sudhir Kumar ji, should take RTI path.

Thanks all to the comments. I agree that RTI would be to make application to the municipality. However, i beg to differ that CPA does not apply to Co-op societies. I believe that member is a consumer of the society and society is duty bound to provide the documents requested by the members. Leave the practical part apart that it is always better to apply to municipal corporation under the RTI.
