Company active or dormant

A limited company has not filed returns from year 2000. The status in reported as 'active' by ROC. Under what circumstances the company can remain active though the company is actually dormant. No one is even traceable at the company's address.

Why ROC keeps such company as active ?

Very vague question.
I don't think some one here is acting as a spokesman of the Registrar of Companies. You could have raised this question with Registrar office.

Dear Sir

The Company Ashwin Wire Ltd (CIN: U31300GJ1995PLC027060) has not been
filing returns from year 2000. But status online as per your site, is
shown as ACTIVE.

Even there is no existence of the company at the registered address.
The company had sold off its assets long back.

Why the company remains active in your records is a cause of concern.

Don't expect any advice from Mr. Kumar Doab, a fake expert, who made you post your ID. appears at this site simply to play a number game to add scores to his credit. However, you can expect him to advise to you contact some local lawyer with unshakable repute, which you would never be able to know who has unshakable repute.

Your ROC is the right Office to satisfy your curiosity and not the LCI, as LCI don't keep records of death/dying/dormant/sleeping or hibernation/in comma of Company.

Normally the Fine by ROC for non filing of Returns is Rs 25000 to 5 lakh. ROC would have have served Notices to the concerned company's address which might have returned also.Once a Name of the company is Registered with ROC it will not be given to /allotted to any one.There is No Provision of Suspension in ROC and such suspensions for non filing is applicable only to BSE,NSE, and SEBI only.

The Company mentioned by the author is in Ahmedabad and it is an unlisted company so BSE and NSE and SEBI options are not applicable.You could write to the Concerned ROC for more details thro RTI for more clarification which would be certainly replied please
