Company laptop stolen

Hi,

I work in an event mgt company and due to late working hrs all employees take the laptop home with the consent of their immediate boss. I did the same but it was snatched when i was walking towards home, i lost 20,000 rs as well with it. The company is now asking me to pay 50000rs for the same (the market value for that second hand laptop must be max. rs.20000). I told them that i am ready to pay you 20,000 but they are forcing me to pay full amount.Not just that, they not only calling me daily on my phone but also calling on my husband's no. and mailing him as well. i have the f.i.r for the stolen laptop but it is serving no purpose. I want to know how can i settle this issue as i cant pay more than 20,000. what legal actions can they take against me? Why do i have to pay for a stolen item that too above its market cost

what is model number of laptop . buy a second hand laptop of same company and use it . refuse to pay the amount demanded by company .


even a new laptop of dell wont cost so much

You will need to pay the depreciated value (not the original cost) of the laptop, but can't give some second hand laptop in lieu of that. You can ask the company, what was the original cost and with date of purchase and can even get the depreciated cost calculated by the accounts & finance department of your own company.

Yes, as Dhingra ji said you have to pay because the laptop was in your personal custody. When you take office equipments at home, and if they are stolen then, it becomes your personal responsibility to compensate the loss occurred to the company. Of course not above its market value. You will have to pay its depreciated value.

I want to know what legal action can they take, incase they refuse my proposal of taking 20,000 from me. i want to tell you that when asked for bill, they said that they dont have it, saying its with company C.A.. they want me to send them a mail admitting the incident- i dont know whether i should do that or not. they saying that they need to send that copy of incident to insurance company. everything seems fishy.plz suggest.
