Company name v/s society name

I have registered a company xyz private limited in 2009, We found another organisation with same name registered under society act. The society is registered before 2005. Can I restrict them to use our company name?

Did you find the society using the exact name of "xyz private limited" instead of "xyz Society limited" or "xyz cooperative Society limited?"

No they are not using private limited in their name. As far as I understand after googling and opinion of experts since unicef is a society someone is open to register unicef private limited?

2) real example : if "Manav Seva" registered as NGO same people can register Manav Seva Private Limited and do commercial activities?

If it is true, Don't you think it is a big mistake of our law and not good for the society at large?
