Compassionate appointment

DEAR SIR,
My father worked in tamil nadu urban land tax department as record clerk from 1988 to 2008. In the year 2008 he expired. While he died he was in service. So we presented an application to the commissioner of urban land tax for appointment under compassionate ground.
We submitted our application on 2009 and at that time there was three members in seniority. I applied for the post of junior assistant. From that day till today there is no change in seniority still it is three persons in the list. I asked the official why it is keep on delaying they are saying that three members are not at all enquiring about the job. Now my question is the commissioner(IAS) can take a decision and can send a notice for those three stating that asking them to give a no objection letter in appointing me abating the seniority.Is there any such power for an IAS officer. Please reply me soon.........

you can write to higher official in the said department, if they are not consider than send representation letter to IAS and CM Cell, they will consider, you can claim within 3 years of deceased,

compassionate appointment is not a matter of right . you may have applied for post of juniour assitant but you cnanot get appointment as matter of right .

n the case of Umesh Kumar Nagpal vs. State of Haryana & Ors., (1994) 4 SCC 138, it was impressed that as a rule, appointments in public services should be made strictly on basis of open invitation of applications and merit. The appointment on compassionate ground was an exception to the aforesaid rule taking into consideration the fact of the death of the employee while in service and leaving his family without any means of livelihood. In such cases, the object is to enable the family to tide over sudden crisis. However, such appointments on compassionate grounds have to be made in accordance with the rules, regulations or administrative instructions taking into consideration the financial condition of the family of the deceased
