How and who would be the competent authourity to take action[discplinary/explanatory/] on a recently retired govt employee and also a first legal witness in a criminal the case.

For diciplinary/explanatory action, it depends on the Rules of the concerned orgn.
For legal witness in a false criminal case, it is the court.

The designated disciplinary authority for the cadre to which the official belongs or his appointing authority, as the case may be, can take disciplinary action within a specified period after retirement, as per the Classification, Control & Appeal Rules applicable to the department.

Am opposed it experts.. The author didn't say anything about the person's offence.. Then how can you give your opinion on that. Without knowing that he had commit any offence or not?

Dear Tom,
The level of Disciplinary Authority (DA) does not depend on the degree of offence but on the status or cadre of the charged official.
As such, the DA is the appointing authority who is empowered to give appointment to the post presently the charged official is holding. The appointing authority does not mean the authority who actually appointed him in the initial post.
In the present case the DA is AA for the post at which the retired employee was serving at the time of his retirement
