Competition Act, 2002

(Querist) 20 June 2008 This query is : Resolved
I would like to ask about MRTP Commission.
When the competition Act, 2002 is going to replace the MRTP Act and Commission. Is there any stipulated timeframe for that?

Repeal of MRTP Act is yet not notified but the recent amendment of 2006 (which is yet to be notified) seeks to repeal the act in the following manner:

The Bill repeals the MRTP Act, 1969 with the provision that the MRTP Commission may continue to exercise its powers for two years in respect of all cases filed before the commencement of the new legislation. After two years, all cases pertaining to monopolistic trade practices or restrictive trade practices would be transferred to the CAT. All cases pertaining to unfair trade practices would be transferred to the CCI. The repeal of the Act would not affect the previous operation of the Act or any penalty or punishment imposed under the Act. Also, the employees of MRTPC would be absorbed by CCI or CAT

Certain provisions such as those relating to establishment of the Commission, appointment of Chairperson and Members, appointment of staff, undertaking of competition advocacy have been notified.
Other provisions of the Act are yet to be notified such as those relating to adjudication of anti-competitive practices and regulation of combinations

In the first year – Commission to undertakeCommission to undertakeCompetition Advocacy only•
From the second year onwards the Commission to commence enquires relating tocommence enquires relating to Anti-Competitive Agreements and Abuse of Dominant Position•
From theFrom the third year onwards, enquiries intoyear onwards, enquiries intoCombinations would commence10
