if you comes under workman category you can directly file a petition under section 33(c)(2) of Industrial disputes Act asking the court to compute the arrears of amount payable to you, before the Labour Court or industrial tribunal which ever applicable to your area. if you are designated as managerial person you are left with the option of filing a civil suit

Thank you all,
Further would like to let you know my case in detail.....
I joined my company after my maternity leave on 1st April. And I resigned on 13th April as got other opportunity. And I was ready to provide notice period. But Upon my resignation as I did not take much in hand after joining, the owner of the company asked me to leave immediately and my last working day was 14th April.
Upon leaving, they asked me to give my maternity payment back which they gave it to me. And I refused the same as it is my right.
Now even after sending reimders, they are not clearing dues, nor answering my mails.
Secondly, they are very cheep people. Being a female, If i send them notice, out side office premises they may do any thing with me. And thinking about same my family members are not ready to send them any notice......
I am in fix.....Please need your help to get my dues and letter with no harm to me.
Please guide....
Regards,
Amee.
