Computerised bank statement as evidence.

Querist : Anonymous (Querist) 09 March 2011 This query is : Resolved 
A private limited company received, by post in bank envelope, the computerised bank statement, on bank's letter head, stating that "the same is a system generated output and requires no signatures".This is the normal practice now a days.

When produced in court as evidence, the plaintiff advocate objected that the same in not acceptable being not signed or stamped.

This is a very genuine and factual case. What will be the court reaction. Is there any judgement on this matter to further prove our genuineness.

The same statement of account can be certified or attested by the branch manager to make it a documentary proof on legal perspective which all bankers oblige.

all the statements must have to be signed and attested by the branch manager and the said manager will have to depose before the court that the same was duly signed and attested by him , then this will go into evidence.

this issue can be resolved by filing the application for additional evidence in case when the witness was not listed and in that case the branch manager in the court will admit the statement of accounts and it will be admissible in court.
