Consequence of concealment of registered address after change from the court

(Querist) 06 September 2014 This query is : Resolved
Sir,

I am LL.B graduate and will be get enrolled soon. My query is "WHAT ARE THE CONSEQUENCE OF CONCEALMENT OF REGISTERED ADDRESS AFTER CHANGE BY PLAINTIFF
I HAVE A CIVIL SUIT IN WHICH PLAINTIFF IS CONCEALING HIS NEW/CHANGED ADDRESS THEN WHICH APPLICATION SHOULD BE FILED FOR DISMISSAL OF SUIT IN A CIVIL SUIT i.e. PERMANENT INJUNCTION
Dr J C Vashista (Expert) 06 September 2014
Whether plaintiff's new/changed address falls within the terrtorial jurisdiction of the same court or not? If yes, no point in harping upon the issue, otherwise, take it a priliminary objection in your written statement alongwith an application for return of suit under Order VII Rule 10 CPC.
Anirudh (Expert) 06 September 2014
Dear Paramjeet,
Please tell whether the plaint has been filed by the plaintiff through a lawyer or in person?
V R SHROFF (Expert) 06 September 2014
challenge JURISDICTION
AS preliminary issue u/s 9 CPC
Rajendra K Goyal (Expert) 06 September 2014
Whether the plaintiff or his lawyer is attending court on dates?

Whether address was changed after filing of the suit?

Whether you are having concrete information about his new address and it falling in out of jurisdiction?
P. Venu (Expert) 06 September 2014
Change of address of the plaintiff has nothing to do with the jurisdiction of the court - jurisdiction is with reference to the cause of action and/or the residence of the defendant(s).
PARAMJEET KAUR (Querist) 07 September 2014
Sir,
The case is at P.E. stage. After 2-3 days of filing the case, the plaintiff went to reside some other place but locked his possession and consistently concealing his present new address from the trial court now i get aware of his new address. Now please tell me which application should I file for dismissing the suit.
Also refer me some citations.

You do not want to answer my query. I refuse to answer yours.
PARAMJEET KAUR (Querist) 07 September 2014
Anirudh sir,
I and plaintiff both have filed their WS and plaint through their lawyers.
Advocate. Arunagiri (Expert) 07 September 2014
It seems that they have filed the WS. When they have appeared, you need not worry about their change of address.
Anirudh (Expert) 07 September 2014
How can the plaintiff file the Written Statement?

In any case, when there is a lawyer for plaintiff, why are you bothered about his changed address? All that you have to do is to serve on the lawyer for the plaintiff.
T. Kalaiselvan, Advocate (Expert) 09 September 2014
There is no issue when the plaintiff chooses to change his address after filing the suit. In any case his counsel on record is attending the case, there is no necessity to make a hue and cry over this sundry matter.
Dr J C Vashista (Expert) 09 September 2014
I find it an imaginary story, isn't it?
Advocate. Arunagiri (Expert) 09 September 2014
Dr.Vashistaji, I am also having the similar opinion.
