Hi Experts
I had an insurance of my car from Oriental Insurance Company. I asked for the cashless insurance and the agent confirmed that it is the cashless insurance which he is giving to me.
After few months i met with the accident and went to service center for the insurance claim there i came to know that the insurance was not cashless.
Then the surveryar came and surveyed the car and confirmed me that he will give me few parts(left side, bumper and headlight) for the compensation. He asked we whether there were any damages during preinspection. I said m not sure, he must be having the details about the pre inspection report how would i know its been long time. he refused that he doesnot have the information about the same and asked me to go ahead with the service.
After the service center has done with there work. I had to pay 22k to them as it was not cashless insurance and during the refund i came to know that they have rejected few parts by the surveyar as it were already damaged in the pre inspection.
Company says surveyar must have the pre-inspection report with him while survey and surveyar on the spot confirms what all parts will be rejected and Surveyar states he didn't have the report company is giving wrong statement.
Both the surveyar and company is not giving the right information.
Please provide your valuable feedback for the same. Can i file a case in consumer court ?

yes, you can file a complaint before consumer court.
process 1. you can take help from the lawyer and file the case.
Process 2. if you are able to fight your case yourself then you can file the same before consumer court.
for court fee you can contact the consumer court office and ask about the court fee.

while filing consumer case do include the agent also as respondent. He may be personally liable if he has exceeded his authority.
