I have filled a case in Consumer forum Thane, Mumbai against a Company Reliance Communication in yrs. 2008.
Till Now i have not received any reply from court & i always attend the Court session.
2 Months ago, for some reason i filled the RTI Application for More information about courts action and their decision.
after all they told me that your decision is pending and it will be decided in the next month of May 06,2010, at 2:00 PM,for final Hearing.
But in the Next month i.e. when i went to court they already changed the time , they have taken the session in the court at 11:00 am instead of 2:00 Pm.
without informed me.
Even when i noticed the scheduled on notice board the time is written 2:00 Pm.
But when i asked some people in the court they told me that no, the session is kept at 11:00 am.
Due to this i was absent and they have given next day for session in the month of
june.for the reason of absent.
I want to know that is any way without informing to us they can conduct the court session.
Is they informed to the person then what is the way?
can i take any action against the Management for this?

REGARDING THE CONSUMER COURT MATTER KINDLY NOTE THAT.
1.YOU HAVE FILED COMPLAINT AT DIST CONSUMER COURT THANE.
2COURT MUST HAVE ISSUED NOTICE TO THE OTHER SIDE.
3YOU MAY CHECK WHETHER NOTICE SERVED ON OTHER SIDE.IN CASE IT IS NOT SERVED THEN YOU HAVE TO SUBMIT APPLICATION FOR REISSUE OF NOTICE AND THEN YOU CAN PERSONALY COLLECT THE SAID NOTICES AND SEND THE SAME BY SPEED POST A.D.AND THE MOMENT YOU GET ACKNOWLEDGEMENT THEN YOU CAN PRODUCE THE SAME IN THE COURT.
4 EVEN AFTER SERVICE OF NOTICE OTHER SIDE DID NOT APPEAR IN THE COURT THEN YOU NEED NOT WAIT FOR THEIR APPEARENCE.BUT YOU HAVE TO FILE APPLICATION TO PROCEED THE MATTER EXPARTE.
5 YOU MAY SUBMIT YOUR AFFIDAVIT IN SUPPORT OF COMPLAINT AND ALSO ENCLOSE THE ATTESTED COPIES OF LIST OF DOCUMENTS AND GET THE SAME EXHIBITED IN COURT.
6.FILE CLOSING PURCIS THAT NO FURTHER EVIDENCE TO BE GIVEN BY YOU.
7.THEN YOU SHOULD SUBMIT WRITTEN ARGUMENTS IN SUPPORT OF YOUR COMPLAINT .
8 THEN THE MATTER WILL BE SCHEDULED FOR JUDGEMENT.
9KINDLY NOTE THAT THIS IS THE MOST SIMPLE COURT MATTER AS COMPARED TO OTHER COURT MATTERS.IN YOUR OWN INTEREST KINDLY KEEP COOL AND DO NOT CREATE ANY FURTHER COMPLICATIONS BY UNNECESSARILY INCREASING DOCUMENTATION BY MAKING APPLICATIONS WHICH ARE NOT CONCERNING YOUR MATTER.YOU MAY KINDLY FOLLOW THE PROCEDURE MENTIONED ABOVE AND YOU WILL SUCCEED.

even though consumer protection act and subsequent establishment of consumer courts were done with good intentions,it is a sad thing that many districts forums are not functioning the it was designed.
it is a known fact that postings in such forums are sometime made for favoured received and given.
anyhow please follow as suggested by Mr.Nandakumar.
even if you do not get justice from district forum,there are state and national forums and most of them are working judiciously.
