consumer dispute - reg

(Querist) 21 December 2009 This query is : Resolved
Please some one guide me

My friend purchased a sofa from a local sofa dealer. My friend ordered for a model by seeing the catalog given by the dealer. The price of the sofa which was agreed between the two parties were 30,000/- and for making the sofa my friend gave him an advance amount of Rs 15,000/-. The dealer gave a oral warranty for two years. The delivery date was fixed as one month from date of order. But the dealer failed to deliver the goods within the specified time. My friend approached the dealer several time for delivery of the goods but the dealer was delaying it by saying some reasons. After an elapse of another 2 months the dealer delivered the sofa to my friend. After delivery it is found that the model which my friend ordered was not done and there was a slight modification in the model. Now the sofa is getting damaged inside due to the modification. Since the dealer has promised for a warranty of 2 yrs he approached the dealer to rectify the defect. The dealer also promised to come and again he is dragging the time and not responding properly. My friend has a bill in the name of the dealer for the said amount. In this circumstance can my friend approach the consumer forum and what are the steps he should take before approaching the consumer forum.

Give a notice to the dealer to describing the defects in the sofa and to repair it or replace it as per the warranty. If the dealer does not comply within the given period then file a complaint in the local consumer forum.

before filing the consumer complaint you issue a notice to replace the sofa set, if the dealer failed to replace it then file a consumer complaint stating that low quality material is supplied and reject to change the same, which also amounts to deficiency in service.
