Consumer Forum

Querist : Anonymous (Querist) 01 March 2011 This query is : Resolved
M.P filed before Consumer Forum in main petition to direct the opposite party to produce document. But opposite side told they has no documents and the consumer forum closed the petition .Whether appeal lie in the close petition ?

When reply of the opposite party is in denial so no cause of action arises to file an appeal against the order of Consumer Forum. If opposite party relies upon the demanded document only then appeal lies otherwise it is a futile exercise.

YOU MAY KINDLY GIVE EXACT DETAILS OF THE MATTER.BUT IN BRIEF YOU MAY PRODUCE ANY DOCUMENT WITH THE PERMISSION OF THE OOURT IN SUPPORT OF YOUR CLAIM.BUT IN CASE OPPOSITE SIDE HAS ALREADY REPLIED THAT THEY DO NOT HAVE ANY DOCUMENTS THEN YOU CAN NOT FORCE THEM TO FILE SAID DOCUMENTS OF YOUR CHOICE.
YOU HAVE NOT MENTIONED THE DETAILS OF THE MATTER AND DOCUMENTS IN DISPUTE.
IN CASE ANY DOCUMENTS FROM THE GOVT ARE REQUIRED YOU MAY GET THE SAME BY RTI APPLICATION OR BY FILING WP IN HC.GOOD LUCK.

Frivolous application, appeal would fail.

is there any finding given by the Forum pertaining to documents?
