dear experts,
whether unfair trade practice of selling goods above the Maximum Retail Price covers under the Consumer Protection Act. ifso what is the provisions along with case laws. and any criminal provisions attracts for the seller ifso provide the same with case laws. Further whether any liability for the manufacturer of the goods.

If any vendor sell the goods above the MRP you can inform the same to your commercial tax department.They will take appropriate action against the vendor.Further it is absolutely unfair trade practice which is restricted by the consumenr protection act 1986. You may approach to the district forum in this regards with documentary evidence.

There is no criminal provision for this. You can go for a consumer case.

File complaint under section 12 of the Consumer Protection Act. The overpricing is surely unfair trade practice and same can not charges unless n certain luxurious outlets it is charges with Luxury Tax.

in some cases, during travel, we can find the selling of food particles in more price than MRP. even you can see the same in Bus stands and Railway stations and in each place we cannot go and contest the case. What is the remedy against these sellers?

Please see the definition of "unfair trade practice" given in Section 2(1)(r)(ix) of the CP Act. Mere charging a higher price than the MRP indicated may not amount to UTP unless it satisfied the definition mentioned above.
