An ex-employee of a Delhi based company,whose Employee Provident Fund (EPF)account was maintained from Meerut EPF Office.In EPF Act ,if a person open a Provident fund account then another two account was simultaneously maintained by EPFO i.e. Employees Insurance Scheme & Employees pension Scheme.In Employees Pension scheme ,no service charge or administrative charge was taken by the authority.Now the ex-employee duly filed his form and submitte it on june 2012 before EPFO ,Meerut.Now the person settled in West Bengal and filed a consumer complain before District Consumer Forum for deficiency in service with compensation for not providing pension in pension scheme in time.Now the Dept claims that Pension scheme will not come under Consumer protection Act as no service/administrative charge was taken.My qestion is:-Whether pension case will not come under C.P.Act?Please cite suitable case Law.
