Consumer protection act and information technology act

(Querist) 17 August 2016 This query is : Resolved
Dear Sir,

I am victim of E-fraud committed by renowned e-retailer in India. I over ordered one product on e-commerce site. But after receiving the product, I find that product with lower MRP was sent as I ordered the product of higher MRP. The invoice was also made as per my order but different product was sent. I feel both e-retailer and seller should be held responsible as most of us do not check and compare the ordered and actual product, tag and specification as per order. Now, my question is what are the sections of different act that they should be charge-sheeted. Can I seek compensation under Consumer Protection Act and what would be the maximum amount of compensation ?

Check the serial no./model mentioned in invoice and on product.

If it is same then you have got the evidence.

Or mention that product invoiced is not supplied to you, as MRP differs.

Obtain screenshots of product/MRP from website and invoice, and actual product.

Lodge complaint in writing ( attach screenshots) with e-retailer, under proper acknowledgment.

You can approach consumer forum for compensation.
