Hello sir,
My wife is asking me maintenance and accomodation facility and has challenged me in court.My wife is a graduate and earning approx 8000(as stated by her) and stays with her mother and brother and her mother is also earning nearly 45000p.m (as stated by her 25000) and also her brother is working.My family parents and brother sister are not working and are financially dependent on me.i am the only bread earner.my father is paralytic.I stay in mumbai.I will not be able to pay 15000 maintenance plus 10000 as rent as per my wifes demand.Please tell me i will not be able to fulfill her demands.how do i do.

The income of her brother and mother is immaterial,they are not taken into account.UR wife may be earning 8000/- officially,but she can claim the comforts and lifestyle enjoyed during marital life.

You establish her income before the court and repudiate her claim for maintenance. However being your legally wedded wife she is entitled for residential rights, so you are required to provide her residence, you can decide upon it accordingly.
