continuous and undisputed possession, claim for title

My client is in possession of a shop sicne last 40 years from the time of his father. The owner of the land died and his children never claimed in the shop ever till now. Electricity meter and house tax is being paid by my client. But the name on the tax receipt include the name of the owner alongwith my clients name. My client want to register the property in his name. Can it be done? Property is of faridabad, haryana. Shop

Obviously it seems that your client is a tenant. Please remember once a tenant always a tenant, unless he shows that he has purchased the property from the owner/land lord.

Is he paying any rent for the shop or not?

When did the owner of the shop die?

Upto what time your client was paying the rent to the owner?

Tenant can not be a owner merely due to the reason that he is tenant from 40 years. He have to purchase the property to become owner.

He is not paying any rent to the owner and the owner died long time back somewhere in 1980, his son also died and now the grand sons of the owner not aware of the shop that they are owner of that shop. He is not paying rent but paying the house tax.
