Contract labour

(Querist) 13 April 2012 This query is : Resolved 
Housekeeping work is given to the contract and an agreement is signed between the contractor and the principal employer. In the agreement it is mentioned that 4 workers should be supplied for the said work. The contractor engaged three workers and he himself is working in the place of fourth person. The contractor is playing two roles i.e., as a contractor and also as a contract labour. Is it permissible. Pl suggest.

Yes unless it os specifically mentioned that the contractor can no function as a worker.

Yes. You can deal with him as a contractor under the contract act for the purpose of implementation of terms of agreement, and on the other hand you can take work from him as you expect from a labourer, as a principal employer.

जब तक संविदा में इसकी स्पष्ट रूप से मनाही न हो आप ऐसा करने के पूरे अधिकारी हैं ,कोई कानूनी मनाही नहीं है..

HE COMPLIED WITH CONDITION OF 4 WORKER .
Housekeeping work was given to the contract, so end product is important, not the no of employee etc. However, as per term, there are 4 staff. So conditions are fulfilled.
