contrary site plan

I am representing a crl case in which investigating officer has submit a site plan in challan,that site plan in police challan is totally contrary to original position/existence i.e. in which i.o. has shown a temple in west direction in fact that temple is in east direction.I want to prove on this point that alleged eye witness was not present at the spot at the time of occurence.plz suggest me some citations.Thanks

Citation on what point? If you want to prove that eye witness was not present on the spot, the site plan hardly helps whether it is right or wrongly drawn. About the site plan you can bring on record either with the help of photographs or another site plan or any witness or even in cross of prosecution witness that the site plan drawn by IO is wrong.

citation not necessary, need to cross examine, with certain suitable actual photographs and video of the scene of offence, in order to prove the absence of the eye wittness.

vinod is quite right in his apprehension because there are few recent judgments where the SC has ignored the improtance of cite plan.
