investigation, police, judge

(Querist) 26 April 2009 This query is : Resolved
investigation of a crime is by and large a function of the police. the role of judge comes into play only after the charge is framed. but the entire prosecution proceeds on case-diary which is wholly prepared by the investigating police officer who enjoys statutory protection not to b interfered by judiciary during investigation.as a result if the police perfunctorily holds investigation or with intentional manipulations, the truth never reveals and the crime can not b adjudicated.if the entire investigation process be viedo recorded with instantaneous storing in an internet site which would then be retrieved and serve as case-docket can we expect better justice?

ur concern is genuine, few years back Hon'ble P&H high court delivered a judgment that in all the NDPS cases the raids and the investigation shall be video recorded reason being each and every FIR was written in a similar manner, in fact no such raids or fair investigations were being conducted.
but that judgment was not even complied later by the high court.

in my opinion for this purpose the legislative bodies will have to make necessary changes in the Cr.P.C, we can not shift the burden on the judiciary.

in fact, the whole investigative process and set up is required to revamped with modern requirements.

Yes. Kiran Kumar is right. Some time back there was a suggestion for requirement of separate investigation agencies which are delinked with police duties.

If investigation is delinked from policing, definitely the quality will be improved and perfunctory or biased or negligent investigations will come down.

Vedeo recording of investigation process shall be recommended, but if it is after putting investigation as a independent unit with the guidance of judiciary then it work efficiently.

video recording may remove possibility of omission in 161 statements giving rise to contradiction and bestowing benefit of doubt to the accused.

I do agree with the suggestion of Mr Thapan regarding the Process of video recording in investigation as suggested by Mr Thapan !
