You simply raised an academic type of question without discussing background of the case.
By the way, how anyone can predict without your discussing what are the contents of the FIR and under which section you were charged?
Importance of the Judgement of SC in Save Good Life Foundation's Case does not necessarily mean that the same should be applied in general on one and all cases without knowing any background of the case or the nature of offence by any person?

His ideal remedy is to stoutly defend the case, and while defending he can make use of and rely upon the SC judgement in Save Good Life Foundation case and other such citations. Further, he has another remedy of filing a petition in the High Court concerned for quashing of the FIR in question.
