My mother has mortgaged her site for a meager Rs 1 lakh from her grandson for a period of 3 years. 6 months before the expiry of 3 years, she died. This deed has been executed without her remaining two sons knowledge. What will happen now to the mortgaged deed. What the sons who were not aware of the deed can do now.

LRs , her sons should be added in place of their late mother and recover the possession of mortgaged property with title deeds from the mortgagee.. and they would get equal share in such recovered property. of their late mother and pay off the mortgage money with interest 0out of the estate of late mother.and distribute the recovered property from the mortgagee in equal shares. or each son would get 1/2 share.In case their late mother's estate is not sufficient to clear the mortgage debt they are personally liable to pay the remaining amount of mortgage money.to the mortgagee.

LR of the deceased mortgagor can claim of redemption of the mortgage. The Mortgage Deed need to be check for any ultra virus provisions that can be done by an expert legal advocate.Try to contract advocate from your known side.
