Notification of award has been done in a tender and immediately purchase/ procurement started from the vendor on the basis of purchase order raised.
Here It was decided with the vendor that Performance bank guarantee and agreement can be executed later on , but without the agreement and PBG payments shall be hold .
Whether the Vendor can consider Notification of award as an Contract

Better discuss, what exactly is the real problem., when everything has been decided verbally by the principle and the contractor without entering in to a formal agreement and performance bank guarantee. You have also not mentioned whether supply started as per the verbal agreement or not.

If a real problem, detailed terms & conditions of the tender document, itself, can be taken as a guiding factor for the contractor.
